Who you are contracting with
PartyPop AI is a web service for creating personalized party games that guests play on their own phones. PartyPop AI is provided by Kate Savage Hart (“we”, “us”), the seller and operator of the service. These terms form the agreement between you and Kate Savage Hart. Contact: support@partypop.ai
Acceptance
By creating, paying for or playing a PartyPop AI game, and by continuing to use the service, you agree to these terms. If you do not agree, please do not use the service. You confirm you are of legal age, and if you are using PartyPop AI for an organisation, that you have authority to bind it.
The Launch Pass
You can build and preview a game for free. A Launch Pass costs $4.99 USD as a one-time payment and unlocks one party: once paid, the room code and QR code become active and your guests can join and play. A pass applies to the single party it was bought for. It is not a subscription and nothing renews or auto-charges.
Payments, taxes and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle is responsible for checkout, payment processing, billing, sales tax/VAT calculation and remittance, invoicing, refunds and chargebacks.
Payment, billing, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Our own Refund Policy sets out our 30-day money-back guarantee. Where a payment is refunded, reversed or charged back, the party it unlocked is locked again.
Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to use PartyPop AI for your own parties. You may not resell or redistribute the service, reverse engineer it, or circumvent its technical limits — including the payment gate on a party room.
Acceptable use
You must not misuse the service. In particular, you must not:
- use it unlawfully, or for fraud, spam or harassment;
- infringe anyone’s intellectual property or privacy rights;
- interfere with its security — no malware, probing, scraping or unauthorised access to other hosts’ or guests’ data;
- enter content that is hateful, harassing, humiliating, dangerous, sexually explicit about real people, unlawful, or that involves minors inappropriately.
You are responsible for the facts and details you enter, for the accuracy of information you give us, for keeping your sign-in credentials confidential, and for making sure the guest of honor is comfortable with the content of the game.
AI-generated content
Questions are generated automatically from what you provide. You are responsible for your prompts and inputs, for having the rights to any content you enter, and for reviewing the output before you launch — you can edit, delete or regenerate any question. Generated content may be inaccurate and is not suitable as professional advice. We may filter, refuse, moderate or remove content and may suspend accounts for repeated or serious violations. If you believe content infringes your rights, email support@partypop.ai and we will review and remove it where appropriate.
Intellectual property
We retain ownership of PartyPop AI, its software, documentation and branding. You keep ownership of the content you enter and grant us a limited licence to host and process it solely to provide the service.
Guests
Guests join with a nickname only, without an account. Hosts are responsible for who they invite and for the conduct of their party.
Availability and warranties
We work to keep the service running, but we do not guarantee uninterrupted or error-free performance, and features may change over time. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can stop using the service at any time and ask us to delete your account and parties.
Liability
The service is provided “as is”. To the extent permitted by law, our aggregate liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we exclude indirect, consequential or special damages including loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence where the law does not allow it.
Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
General
You may not assign these terms without our consent; we may assign them as part of a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the seller’s place of establishment, and the courts there have jurisdiction, without affecting any mandatory consumer rights you have locally.
